These Terms of Use ("Terms") are an agreement between you and capVentures ("we", "us") governing your use of the Word War: Duel mobile application ("the app"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, decompile, redistribute, or create derivative works from the app, except where that restriction is prohibited by applicable law.
The app uses Sign in with Apple. You are responsible for activity that occurs under your account. You must be at least 13 years old to create an account. Do not create multiple accounts to gain an advantage in the daily puzzle, wars, or leaderboards.
The app offers a daily word puzzle, practice modes, and competitive multiplayer "wars" between players and teams. You agree not to:
We may adjust or void scores, and suspend or terminate accounts, that we reasonably determine have violated these rules.
You may choose a username and a display name, upload a profile image, and name wars and teams. You are responsible for that content, and you represent that you have the right to use it.
There is zero tolerance for objectionable content or abusive behavior. You may not submit, display, or transmit content that is unlawful, hateful, harassing, threatening, abusive, defamatory, sexually explicit, violent, infringing, or that impersonates another person or organization. This applies to every place you can enter text or an image — usernames, display names, war names, team names, and profile, war, and team images. We also automatically screen usernames, display names, and team names for offensive content.
You grant us a limited license to store and display your username and profile image to other participants in wars and teams you join, for the purpose of operating the game.
Reporting and blocking. In a war or on your team, tap the … next to a player and choose Report Player to flag objectionable content, or Block Player to hide that player's name and photo from you everywhere in the app. You can also email support@wordwarduel.com.
We review every report and act on it, typically within 24 hours. Acting on a report may mean removing the offending name or image, suspending the account, or permanently terminating it. Accounts that post objectionable content or abuse other players may be removed without notice and without refund. We may also remove content and terminate accounts on our own initiative where we determine these Terms have been violated.
The app offers an optional premium subscription. It is billed by Apple through your Apple Account, not by us — we never receive or handle your payment details.
Auto-renewing subscription terms
Refunds are handled by Apple under the Apple Media Services Terms and Conditions. We cannot issue refunds directly. To request one, visit reportaproblem.apple.com.
Any in-game credits, benefits, or virtual items have no monetary value, cannot be exchanged for cash, and may be modified or discontinued.
The app depends on our servers and on your internet connection. We may modify, suspend, or discontinue features — including wars, teams, and the daily puzzle — at any time. We do not guarantee uninterrupted or error-free operation.
You may stop using the app at any time. You can delete your account from inside the app at Profile → Delete Account; deletion is immediate and irreversible, and is described in the Privacy Policy. If you cannot access the app, email support@wordwarduel.com. Deleting your account does not cancel an active subscription — cancel that separately in your Apple Account settings, as described in Section 5. We may suspend or terminate your account if you materially violate these Terms. On termination, the license in Section 1 ends.
To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, capVentures will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, arising out of or relating to your use of the app. Our total liability for any claim relating to the app will not exceed the greater of US$25.00 or the amount you paid us for the app in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
These Terms are between you and capVentures only, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
These Terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to its conflict-of-laws rules, except where mandatory consumer-protection law in your country of residence provides otherwise.
We may update these Terms. We will change the "Last updated" date above and, for material changes, provide notice in the app. Continued use after changes take effect means you accept the updated Terms.
